This privacy policy (“Policy”) describes how High Street Insurance Partners Inc. and its subsidiaries listed here (collectively, “Highstreet,” “Company,” “we,” “us,” “our”) collects, uses, stores, and discloses personal information when you visit our top-level business website www.myhighstreet.com, www.highstreetpartners.com, and the websites belonging to our subsidiaries (collectively, the “Sites”), or through your use of or communication with us in connection with our products, services, or our other platforms, applications, or offerings (“Services”). To the extent this Policy and a policy belonging to any of our subsidiaries conflicts, the relevant provision of this Policy will apply.

Please note this Policy is intended to apply under circumstances where we control the collection of your Personal Information and determine the purposes and means of its use and processing. Please read this Policy carefully to understand our practices regarding your Personal Information. By accessing or using the Sites or Services, you agree to the practices disclosed in this Policy. If you do not agree to this Policy, you should not use or access the Sites or Services.

Third-Party Links; Securities Transactions

Our Sites may contain links to third-party websites. We may also partner with third parties that may use technologies such as cookies, widgets, and links to gather information about users on our Sites. We do not have control over third party websites, and any third party’s website’s privacy practices are not governed by this Policy. Any time you leave our Sites to a third party’s website or interact with a third-party link or other technology, you should exercise caution and review the privacy statement for the third party’s website to learn more.

Securities transactions, if and when presented or effected, are presented or effected on behalf of, and under the supervision of, third-party securities firms that are not affiliated with Highstreet. We do not have control over these firms’ practices, including relating to the websites.

Categories of Personal Information We Collect:

We may collect certain information when you use or access our Sites or Services and depending on our interaction with you. “Personal Information” is information that identifies or could reasonably be linked with a particular person or household and can be used to identify you. Below are specific examples of the Personal Information we may collect. Personal Information does not include information that has been de-identified or aggregated and that cannot reasonably be used to identify you, nor does it include information subject to the Gramm-Leach-Bliley Act, HIPAA, or other sector-specific state or federal privacy laws. We may use, share, transfer, or sell de-identified or aggregated information for any lawful purpose.

We collect the following categories of Personal Information:

  • Identifiers, such as name, postal address, e-mail address, telephone number, and internet protocol address.
  • Account information (e.g., username, email, and password on your Highstreet account).
  • California Customer Records information, such as name, address, telephone number, signature, Social Security number, driver’s license number, passport number, insurance policy number, education, employment and employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information, to the extent identifying a California consumer. Some Personal Information included in this category may overlap with other categories.
  • Demographic information, such as gender, age, nationality, marital status, and lifestyle information.
  • Professional and employment information, such as job title, company name, salary, benefits information, and information about education-related history or background.
  • Health information, such as information about your health status, medical records, and medical assessment outcomes.
  • Claims data, such as information about any claims concerning your insurance policy.
  • Financial and payment information, such as payment card and bank account details, details of your credit history and bankruptcy status.
  • Commercial information, such as records of personal property, products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies.
  • Social media information, such as when you like or engage with one of our social media posts or profiles.
  • Internet or other similar network activity, including browsing history, search history, links, and information regarding your interactions with the Sites.
  • Geolocation data regarding your visit to our Sites, including internet protocol addresses, which provides information about approximate location.

Some of the above personal information may be considered Sensitive Personal Information under state privacy laws, such as financial or health information. Highstreet uses Sensitive Personal Information for specific purposes such as processing transactions or providing you with the product or service you requested from us. Highstreet does not use any Sensitive Personal Information to infer characteristics or for purposes not permitted by law. Where required, Highstreet will obtain your consent when processing Sensitive Personal Information unless otherwise permitted by law. Please note, if you do not consent, Highstreet may not be able to provide you with the specific product or service you request.

By submitting a telephone number or other contact information to Highstreet, you agree that a representative or service provider of Highstreet can contact you at the number you provide, potentially using automated technology (including texts/SMS messaging). Message and data rates may apply. Your consent is not an obligation to engage with Highstreet, but not providing contact information may limit Highstreet’s ability to engage with you and provide relevant Services as described below. You may opt out of such messaging as described below in Your Personal Information Choices.

Sources for Personal Information We Collect:

  • We receive Personal Information directly from you, such as when you visit our Sites, use or request the Services, or communicate with us regarding the Services (including through text/SMS messaging or webforms).
  • We receive Personal Information, such as technical data, usage data, and internet and other similar network activity, through automated technologies, such as cookies, web beacons, and other interactions with our Sites. Please see our Cookie Manager for additional information and our Cookie Settings link at the footer of our Sites. We may also use session replay or session recording cookies for real-time collection, storage, use, and sharing of information on your device (such as IP address, device type, and settings), or information provided by you (such as mouse movements or clicks) to help us improve our Sites and make them more convenient for users. Session data may be shared with our session replay vendors that may only use it to provide the service to us.
  • We receive Personal Information from our service providers and third parties that help us provide the Sites and Services, such as data analytics providers, advertising networks, data brokers, and internet service providers.
  • When we provide services to our clients, we may collect Personal Information from our clients about you, such as your name, contact details, date of birth, gender, marital status, financial information, employment information, and benefits information. We may also collect or receive Personal Information from public sources including, but not limited to, social media and other websites that enable social sharing, from government agencies, or public or third-party information sources.
  • We receive Personal Information from our insurance carrier partners in connection with the Services we provide to our clients.

Cookies and Tracking Technologies

We use first and third-party cookies, pixels, and web beacons to gather traffic statistics and conduct management and visitor tracking of the Sites. Our cookies collect information about you and your visit to the Sites. We use this information to remember you and to improve your experience on the Sites. Some of the technologies we use on our Sites are strictly necessary for the functionality of the Sites, while others improve functionality but are not strictly necessary. Some cookies help improve the performance of the Sites (such as by gathering analytics data), while others help provide targeted advertising services to you (like ads that you may be interested in). These tools allow us to measure response to our communications and improve our Sites.
  • Other Technologies. We collect many different types of information from other technologies to improve the quality of our Sites and the Services we provide. For example, we may collect usage data and other information about the device you use to access our websites, your operating system and/or mobile device type, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone where your device is located.

Pages of our Sites may utilize session replay technologies to analyze user interactions and improve our services. We utilize Hotjar to track behavioral metrics, heatmaps, and session replays. These tools capture user interactions, such as clicks, mouse movements, and scrolls, helping us measure engagement, diagnose usability issues, and enhance user experience. Usage data is collected using first- and third-party cookies and other tracking technologies. This data helps us assess the popularity of our products/services, optimize website performance, enhance security, and support advertising efforts. We do not currently respond to web browser “do not track” signals or other mechanisms that provide a method to opt out of the collection of information across the networks of websites and online services in which we participate. For more information, visit www.allaboutdnt.org.

How We Use Personal Information:

We use your Personal Information for our business purposes, including to provide and improve our Sites and Services, to respond to your inquiries and requests, to process transactions, to prevent fraud and other criminal activity, for marketing purposes, and for other purposes for which we may notify you. For example, we may use your Personal Information for the following and other purposes as permitted or required by law:

  • Provide the Sites and perform Services for you and our clients. We use Personal Information to provide our Services, including insurance brokerage, employee benefit, and financial planning services.
  • Communicate and market to our clients and prospective clients, including to respond to direct requests, engage in correspondence (including through text/SMS where you have opted in) with clients regarding ongoing business issues, and to provide newsletters, informational material, and other marketing communications.
  • Customize and improve the Sites or Services through troubleshooting, data and trend analysis, audits, testing, research, statistical, and survey purposes, as well as improving our Services and analyzing the effectiveness of our promotional campaigns.
  • Meet our obligations and enforce our rights arising from any contracts with you, including for billing or collections.
  • Manage our relationship with you, including for online account creation, maintenance, and security, and reaching out to you with information about your account.
  • Exercise or defend our legal rights and the rights of our employees and customers.
  • Crime and fraud prevention. We process Personal Information to prevent, detect, and investigate security issues, crime, and fraud and as part of our legal obligations.
  • Business transactions. We process Personal Information in the event of a sale, acquisition, or reorganization, for planning, due diligence, and post-closing purposes related to the business transaction.
  • Complying with legal requirements. We process Personal Information about our clients and other contacts to comply with legal and regulatory requirements, such as for screening, “Know Your Customer” compliance, and to defend and prosecute investigations and litigation.
  • For any other purpose with your consent.

We may aggregate, anonymize and/or deidentify data we collect about customers and visitors to our Sites and use it for any purpose, including product and service development and improvement activities. We commit to maintaining any deidentified data in a deidentified form and will not make any attempt to reidentify that data.

How We Disclose Personal Information

  • To our subsidiaries in the Highstreet group of entities to provide the Sites and Services for you.
  • To our insurance carrier partners to provide you with the Services and services provided by such carriers.
  • To our service providers we use to facilitate or help provide the Services and the Sites, such as vendors, contractors, and other third parties such as email providers, payment processing providers, customer service and support services, marketing and advertising providers, text/SMS messaging providers, and web hosting and development companies. Our service providers do not sell or share or otherwise use Personal Information for any other purpose other than performing the functions for us.
  • With professional advisors, consultants, experts, and agents of Highstreet to assist in administering our Services.
  • In connection with a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy, or other change of ownership or control of Highstreet or its assets (whether in whole or in part).
  • To any party with your consent.

In addition, where consistent with applicable laws and regulations, we may disclose Personal Information:

  • to prepare, negotiate, or perform a contract with you;
  • to respond to subpoenas, court orders, or other legal process or otherwise as required by law or the competent government or judicial authorities;
  • to establish or preserve a legal claim or defense; or
  • to prevent fraud or other illegal activities, such as willful attacks on our information technology systems.

We may also disclose aggregated, anonymized, or deidentified information to third parties without restriction.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories of third-party recipients of Personal Information exclude text/SMS messaging originator opt-in data and consent; this information will not be shared with or disclosed to any third parties except for our service providers directly involved in delivering the text/SMS messages.

Your Personal Information Choices

You have certain choices regarding our use and disclosure of your Personal Information for promotional purposes. You may opt out from receiving electronic communications from us by contacting us at [email protected]. If you no longer want to receive promotional-related emails or text messages from us, you may opt out according to instructions in such communications, including by texting “STOP” or “HELP” depending on the opt-out instructions in your text/SMS messages. Please note that if you opt out of receiving marketing-related messages, we may still send you important administrative messages and alerts.

As described in the Cookies and Tracking Technologies section above, you also have the right to set your browser to block cookies to opt-out of certain cookies being served by the Sites to your device, or you may adjust your cookie settings to block non-essential cookies. Please note that blocking all cookies may impact the functionality of the Sites.

Notice to California Residents

Under the California Consumer Privacy Act (CCPA/CPRA), California residents have certain rights regarding their personal information. If you are a California resident, the following applies to you:

  • Access. You have the right to request that we disclose certain information to you about our collection, use and disclosure of your Information over the past 12 months. Once we receive your request and verify your identity, we will disclose to you: (1) the categories of Personal Information we collected about you; (2) the categories of sources for the Personal Information; (3) our business or commercial purpose for collecting or disclosing that Personal Information; (4) the categories of third parties with whom we shared that Personal Information; and (5) the specific pieces of Personal Information we collected about you in the preceding 12 months.
  • Correction. You have the right to request that we correct any inaccurate or incomplete Personal Information about you.
  • Deletion. You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain legal exceptions or obligations.
  • Opt-Out of Sale or Sharing/Targeted Advertising/Do Not Sell or Share My Personal Information. You may request to opt out of the “sale” or “sharing” (as defined by the CCPA) of Personal Information, specifically with regard to certain types of behavioral or targeted advertising based on information collected about you on non-affiliated websites, applications, or services through cookies or website technologies. Highstreet may “sell” or “share” your Personal Information if you enable certain cookies and tracking technologies on our Sites. You may revoke your consent to the use of these cookies, including previously-enabled cookies, by clicking on the Do Not Sell or Share My Personal Information link in the footer of the Sites or by adjusting your cookie settings by clicking the paperclip icon on the bottom of the Sites.
  • Non-Discrimination. We will not discriminate against you for exercising any of your rights by: (1) denying you goods or services; (2) charging you different prices or rates for goods or services; (3) providing you a different level or quality of goods or services; or (4) suggest that you may receive a different price, rate, or level of quality for goods or services.
  • Authorizing an Agent. You may designate an authorized agent to submit your consumer request on your behalf, so long the authorized agent has your written permission to do so and you have taken steps to verify your identity directly with us. Depending on your request, we may require additional information to verify your identity.

Please note that this Privacy Policy does not apply to the practices of third parties on their own websites and digital properties, including our insurance carrier partners, service providers, marketing service providers, or other third parties. When you access a third party’s website through links on our Sites, information collected from you on those third-party websites is governed by their privacy policies. We are not responsible for and do not control the security or privacy of your information when you visit those websites. We encourage you to read the privacy policy of every website you visit.

We and certain third-party partners may place advertisements for our Services on websites, applications, and platforms operated by others. If you would prefer not to receive interest-based advertising, you can opt-out of this activity at the Digital Advertising Alliance (DAA) website at optout.aboutads.info, optout.networkadvertising.org, optout.privacyrights.info, and www.aboutads.info/appchoices.

If you do not want the Sites or Services to collect information about you through cookies, you can adjust your cookie settings by clicking the paperclip icon on the bottom of the Sites and may also set your web browser to reject cookies. The security of your Personal Information is important to us. We employ a number of organizational, technical, and physical safeguards designed to protect the Personal Information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the absolute security of your Personal Information. Your submission of any Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites.

Data Retention

We will only retain your information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for your information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your information and whether we can achieve those purposes through other means, the feasibility of data deletion, and the applicable legal requirements.

Children’s Information

We do not directly provide any Services to children under 18 years of age and children are prohibited from using or accessing the Sites or Services. Our Sites is not intended for or directed at anyone under the age of 18 (or such other age as may be restricted under local law). If we are made aware that we have received information in violation of our Policy, we will use reasonable efforts to locate and remove that information from our records. Certain Services require use of data related to children, such as date of birth, address, and other identifiable information (such as naming a child as a beneficiary of an insurance policy). Such information is not collected directly from children but is instead provided by other parties such as a parent or guardian, a customer, or an insurance carrier.
